Concretising corporate human rights responsibility through the case law of the National Contact Points for the OECD Guidelines for Multinational Enterprises

Subject Area Public Law
Term since 2021
Project identifier Deutsche Forschungsgemeinschaft (DFG) - Project number 464350494

The project analyses the concretisation of the corporate responsibility to respect human rights through the decisions of the National Contact Points (NCP) for the OECD Guidelines for Multinational Enterprises. The project focusses on the comprehensive and systematic collection and analysis of the NCP case law to the extent this is relevant for the corporate human rights responsibility. The case law will be categorised on the basis of specific criteria which will make similarities and differences in dealing with certain questions visible. In addition, common elements of the decisions will be distilled to concretise the human rights responsibility of corporations further and through general principles. The project will contribute significantly to a better understanding of the corporate human rights responsibility and the corresponding human rights due diligence. The contribution of this project will be distinguishable from existing research and practice in the field of corporate responsibility which have been base either on general abstract principles or on singular cases. Contrary to this, the current project's analysis of a large number of cases could lead to a comprehensive understanding and produce important insights for the future development of mandatory human rights due diligence legislation.
