Duties of right and duties of virtue. Kant’s division of the Metaphysics of Morals in the view of the „Table of the categories of freedom“

Final Report Abstract

After Kant had laid the foundations for his moral philosophy in the two foundational writings of the 1780s, the Groundwork of the Metaphysics of Morals of 1785 and the Critique of Practical Reason of 1788, he elaborates it into the system of the doctrine of duties in the Metaphysics of Morals of 1797. Especially the three introductions to the late writing – the one to the entire work as well as those to its two parts – focus on the contrast between duties of right and duties of virtue. In addition, Kant also distinguishes the legislation of pure practical reason, around which his foundation of moral philosophy is centred in the two foundational writings, into the juridical and the ethical legislation. The elaborated system of the doctrine of duties owes its division into Right and Ethics to this contrast; the first part of the work is defined by juridical legislation and the second part by ethical legislation. The features by which Kant marks the two distinctions partially overlap. All the features that characterise the two types of legislation can also be found in the two classes of duty, which, however, also have additional features. The opposition of duties of right and of virtue is characterised by nine features in the late writing, while the opposition of juridical and ethical legislation, and thus the division of the Metaphysics of Morals into Right and Ethics, is characterised by four. The project addressed this complex of problems: Kant’s differentiation between duties of right and of virtue as well as the partially overlapping differentiation between juridical and ethical legislation in the Metaphysics of Morals. The guiding questions were: how are the distinguishing features to be understood in each case? How are they related? And how are they justified by Kant in each case? To date, there is no examination in the research literature that deals with this complex of problems at the level of a monograph. In this respect, the project has attempted to close a gap in Kant scholarship – a desideratum that is all the more urgent as interest in the Metaphysics of Morals has been steadily increasing in recent years (also and especially in the English-speaking world). In addition, the project examined the distinguishing features used by Kant for the first time from the perspective of the “Table of the Categories of Freedom”, which can be found in the second Critique, and thus ultimately from the perspective of the so-called table of judgements in the Critique of Pure Reason of 1781/87 on which it is based. For, after all, Kant explicitly states that the table of the categories – and thus ultimately the table of judgements – outlines the ground plan for the system of the doctrine of duties which was still to be developed at that time.
