Despite the great attention that conceptual legal scolarship has received in recent years, the methods by which conceptual legal scolarship proceeds and the instruments it uses in its work have remained largely obscure. The aim of my project is to fill this gap to such an extent that a firmer foundation is laid by 1.) opening up the general instruments of conceptual legal scolarship, 2.) investigating their role in the process of order formation and 3.) analyzing and working through this process itself. On this basis, 4) concrete instructions for the elaboration of the instruments and the construction of a legal order will then be developed.
