Knowledge is an essential requirement for public decision-making. But the information and capacities which enable the generation of such knowledge are primarily available at companies - especially in areas of law dealing with risk decisions. Therefore these private organizations are forced by law to generate the necessary knowledge and to enable the public authorities to share this corporate knowledge(access). The analysis of this access is based on two examples: risk management in the banking supervisory law and employers' liability insurance association in employee protection law. The legal arrangements of the state's access to corporate knowledge, its theoretical comprehension and its constitutional framework are the objective of the project.
