Final Report Abstract

The legal protection of cultural property in private hand classified as “nationally valuable” has been controversial right from its beginnings in the early twentieth century. The new law from 2016, which amended a predecessor that had been in force in the Federal Republic of Germany since 1955, was no exception. Before being passed, it was intensively discussed and heavily criticized by stakeholders and the public alike. To date, however, the law has only been examined from a legal perspective. The project therefore brought together art historians and legal scholars, who together examined the beginnings during the Weimar Republic and evaluated the law in force since 1955 on the basis of extensive archival studies. They identified both recurring conflicts and practical problems in implementation and developed suggestions for reform.
