Against the backdrop of the relationship between economics and the law the question is examined how creative designs can be used to challenge the application of the law. From this perspective design patterns can be illustrated showing how state actors can act in order to bypass an otherwise openly breach of the law. This is framed as the "invisible hand of the state". The design patterns apply to different sources and contexts of the law. The work takes upon questions of the German and European constitutional order as well as international law to demonstrate the underlying mechanisms. Its conclusions lead to a new framework providing an explanation for the genesis and evolution of certain legal disputes.
