Individualized Sentencing and Reconviction Rate of convicted Offenders - A nationwide analysis based on Data from the German Federal Register of Criminal Records

The actual proposal is connected directly to the project “Recidivism of convicted offenders” founded by the DFG. With the same research approach used in the current project data from the German Central Register of Criminal Records will be collected and connected to the data of the further projects, to get longer observation periods (B, C). Additionally, the scientific interest now focusses three further questions: First we are going to focus regional differences concerning judicial sentencing between the federal states of Germany and describe the range of sentences in regard to central criteria such as offense type and previous convictions. Thus, orientation for judicial sanctioning routines could be derived. Second we are going to focus the new definitions of offences concerning sexual assault and sexual harassment, which are defined in the criminal law reform in 2016. With the date available it could be analysed how relevant these statutory offences are in the judicial system (E). Last not least the data of the planned study will be used in order to calculate individual risks of reoffending, considering all the data available in the Central Register (concerning the person and her preconvictions, the offence type and the sentence) in order to provide a basis for prognostic ratings (F).
