Literature on the horizontal effect of fundamental rights fills entire libraries. However, recent developments reveat that many central questions remain unresolved or have tobe asked again - cf. the recent case law of the CJEU and the BVerfG as weil as the new challenges of digitalization and social media, inter alia. In this light, the book reconsiders the effect of fundamental rights between private actors under German law from six perspectives: analytical, doctrinal, practical, constitutional, ethical and from the perspective of democracy theory. lt pleads for a modified approach of direct applicability of fundamental rights between private actors.
