The law on quality assurance in the transplantation sector is characterised by a complex multi-level and multi-actor structure. In addition to the federal quality assurance regulations and the guidelines of the Joint Federal Committee, the German Medical Association is also called upon to legislate in this area; there is also a link to hospital planning, for which the federal states are responsible. In the project(1) We will analyse the structure of the law on quality assurance in transplantation(2) Legal problems and regulatory deficits - especially with regard to the quality assurance needs of the transplantation system - are identified, taking into account the constitutional framework,(3) Proposals and recommendations for the further development and harmonisation of this area of law should be made, as transplantation is particularly dependent on transparent regulatory structures in order to gain the confidence of citizens.
