Political Conditionality as a Strategy of Subsidy Administration
Final Report Abstract
The subject of this project was the phenomenon of the conditionalization of cash benefits, already known from European law, transferred to the area of national subsidy law, including subsidy administration, collectively referred to as subsidy law. In this context, conditionality means that the state, in the case of an existing or new subsidy or funding program, in addition to the specific decision on what is to be funded, also specifies further requirements or behavioral requirements that the recipient must fulfill in order to receive the grant that has already been determined in terms of its substance. It had to be clarified whether and, if so, to what extent this phenomenon already exists and whether it is possible to systematize it, which then raises the question of the legal admissibility of such a grant practice. It should also be noted that the phenomenon was uncharted legal territory within subsidy and grant administration at the time the application was submitted, and that the legal concept of conditionality had previously only been conceptualized in European law. The research task of the funded project was to clarify and prove that this phenomenon can also be found in grant administration and what the legal embedding looks like. The applicant was able to contribute related research insofar as he has long been involved in a similar phenomenon within public procurement law, so-called strategic procurement. It was possible to prove that conditionalization occurs in public procurement law. A fundamental distinction was made in the investigation between economic subsidies on the one hand and the area of funding administration in the scientific and cultural sector on the other. Due to the abundance of potential concerns that could be subject to con-ditionalization, the focus was narrowed to those of the ESG grid (Environmental, Social, Governance) in order to be able to meaningfully narrow down the topic and categorize the respective links. The question of the legitimacy of the respective links was then considered and answered. As far as the implementation of individual programs in practice was concerned, it was interesting to compare the design at the theoretical level with reality in order to be able to draw conclusions about implementation in general. In addition, the implementation and sanction regime of conditionality programs was also examined as a whole. Concrete suggestions for practical implementation were outlined.
