Private International Law from the 14th to 17th century

Subject Area Private Law
Term since 2025
Project identifier Deutsche Forschungsgemeinschaft (DFG) - Project number 563315264

In this volume the central sources of late medieval and early modern conflict of laws are transcribed and translated to German. There are a few transcriptions and translations of passages of these sources available to English or French; but a complete edition of these important and relevant texts is not available on the German market – even though they have played an important role for the development of German conflicts theory. After the medieval theories of Bartolus de Saxoferrato and Baldus de Ubaldis the relevant passages of the early modern French jurists Charles Dumoulin and Bertrand d'Argentré and the writings of the Dutch jurists Paulus and Johannes Voet as well Ulrik Huber will be presented. The treatises of the German jurists will not be part of the volume, since they have been published in 2002 (von Bar/Dopffel (Hg.), Deutsches Internationales Privatrecht im 16. und 17. Jahrhundert, 2 Bde, Tübingen 2001). Please find the transcriptions and translations attached to the application.
